Terms of Service

By accessing or using Linguenta ("the Platform"), operated by Linguenta ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all users, including free and paid subscribers. We may update these Terms at any time. Continued use after changes are posted constitutes acceptance.

You must be at least 16 years old to use Linguenta. By using the Platform, you confirm that you meet this requirement and that the information you provide is accurate and complete. You may not use the Platform if you are prohibited from doing so under applicable law in your country.

To use most features, you must create an account using a valid email address and password. You are responsible for: — Keeping your login credentials secure and confidential — All activity that occurs under your account — Notifying us immediately if you suspect unauthorised access (contact support@linguenta.com) We reserve the right to suspend or terminate accounts that violate these Terms.

Linguenta is an AI-assisted English language learning platform providing: — Conversation practice with AI tutors — Grammar exercises and explanations — Vocabulary learning and review — Pronunciation scoring and feedback — Writing analysis and coaching — AI Coach for personalised learning support — Progress tracking and CEFR level assessment The Platform is provided "as is" and features may change, be added, or removed at any time. We do not guarantee that the Platform will be available without interruption.

Linguenta uses artificial intelligence to generate educational content, corrections, feedback, and learning exercises. You acknowledge that: — AI outputs may be inaccurate, incomplete, or unsuitable for your specific needs — AI responses are for educational purposes only and do not constitute professional language teaching, legal, medical, or financial advice — You should use your own judgement when applying AI feedback — We are not liable for any decisions made based on AI-generated content

You retain ownership of content you submit to the Platform (text, audio recordings, support messages). By submitting content, you grant Linguenta a limited, non-exclusive licence to process that content solely to provide the Platform's services. You are responsible for ensuring that content you submit does not violate any applicable law or third-party rights.

You agree not to: — Use the Platform for any illegal purpose — Submit content that is abusive, offensive, defamatory, or harmful — Attempt to reverse engineer, scrape, or exploit the Platform — Share your account credentials with others — Attempt to circumvent subscription limits or access controls — Use the Platform to generate spam, misinformation, or harmful content — Interfere with the Platform's security or performance Violation of these rules may result in immediate account termination without refund.

All content on Linguenta — including the software, design, curriculum, exercises, and AI-generated outputs — is owned by or licensed to Linguenta. You may not copy, distribute, or create derivative works without our prior written consent. Your personal learning data (your progress, scores, and history) belongs to you and can be exported at any time from your Privacy settings.

Linguenta offers free and paid subscription plans. Payments are processed by Stripe, our Merchant of Record. By purchasing a subscription, you also agree to Stripe's terms and privacy policy. Subscription terms, pricing, and plan features are described in the Subscription tab of your Profile. By subscribing, you authorise recurring billing at the stated price until you cancel. Free users have access to limited daily and monthly usage allowances as described in the Subscription section. We reserve the right to change free plan limits at any time with reasonable notice. Free plan access may be suspended if it is being abused or used in violation of these Terms.

We aim to provide the Platform with high availability, but we do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or technical issues may cause temporary unavailability. We will not be liable for losses caused by service interruptions, subject to applicable law.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Linguenta SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS — IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to indemnify and hold harmless Linguenta, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

The Platform integrates third-party services including AI providers (OpenAI), speech processing (Deepgram), payment processing (Stripe), and infrastructure (Supabase). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or content of third-party providers.

Either party may terminate the agreement at any time. You may delete your account from the Privacy tab of your Profile. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Platform will cease. Your data will be deleted in accordance with our Privacy Policy. Paid subscription access ends at the end of the current billing period unless otherwise required by applicable consumer law.

These Terms are governed by the laws of [COUNTRY/STATE]. Any disputes shall be subject to the exclusive jurisdiction of the courts of [COUNTRY/STATE], unless mandatory consumer protection law in your country of residence provides otherwise. EU/UK consumers retain the right to bring claims before the courts of their country of residence.

We encourage you to contact us first to resolve any disputes informally at support@linguenta.com. If a dispute cannot be resolved informally, it will be submitted to the jurisdiction described above. EU consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, Cookie Policy, and Subscription & Refund Policy, constitute the entire agreement between you and Linguenta regarding the Platform and supersede all prior agreements.
